Last week, the Supreme Court heard its first capital punishment case of this current term, and according to Mark Joseph Stern of Slate the two hours of oral arguments showed just how dived and irritated with each other the Justices are over the issue. The arguments, which were heard, last Wednesday combined two cases out of Kansas and sought to answer two constitutional questions related to jury instruction and sentencing and Mark joins me today to talk all about the case and difference of opinions concerning the death penalty among the Justices.
