3:35pm ET - In 1974, when the first federal bill to protect LGBT workers was introduced, the atmosphere for equality in America was unfriendly at best, but things did get better. The military’s ‘don’t ask, don’t tell’ policy, was repealed in 2010, DOMA was declared unconstitutional in 2013, and now nineteen states and the District of Columbia recognize full marriage equality, with more to come.  Yet most LGBT Americans have no protection from being fired from their job because of their sexual orientation or gender identity.  Legislation to address that problem has been kicking around Congress for forty years, and it is now called the Employment Non-Discrimination Act, or ENDA, but Congress has not succeeded in passing it.  Joining us to discuss ENDA and how the religious exemption in the current version could enshrine the idea that LGBT equality is incompatible with the free exercise of religion is Tobias Barrington Wolff a Professor of Law at the University of Pennsylvania Law School and an expert on constitutional law, LGBT rights and civil litigation. He has also served as the Chair of LGBT policy for the 2007–08 presidential campaign of Barack Obama.
